KULA STUDIO TEACHER TRAINING TERMS & CONDITIONS

These Terms & Conditions apply to all teacher training programmes offered by Kula Studio / Kula Yoga Ltd (“Kula”, “we”, “us” or “our”), including 200-hour yoga teacher trainings, Yin Yoga trainings, anatomy trainings, workshops and other professional education programmes.

By enrolling in a Kula teacher training, paying a deposit or otherwise confirming your place, you acknowledge that you have read, understood and agreed to these Terms & Conditions.

1. BOOKING & ENROLMENT

Your place on a teacher training is confirmed once the required deposit has been received.

Unless otherwise stated, deposits are non-refundable.

A deposit may, with Kula's approval, be transferred to another eligible participant in accordance with Section 4.

The specific course information provided at the time of enrolment — including dates, hours, course fee, payment schedule, inclusions and any prerequisites — forms part of your enrolment agreement.

2. COURSE FEES & PAYMENT

The total course fee and payment schedule will be clearly communicated at the time of booking.

Where a payment plan is offered, the participant remains responsible for the full course fee, regardless of whether they subsequently decide not to complete the training.

All instalments must be paid the day before the teacher trainings commences.

If a payment is overdue, Kula may:

  • suspend the participant's access to the training;

  • withhold course materials;

  • withhold certification; and/or

  • cancel the participant's enrolment,

subject to applicable law.

Cancellation or withdrawal from the course does not automatically cancel any outstanding payment obligations that have already become due.

3. NON-REFUNDABLE DEPOSIT

The initial deposit is non-refundable.

The deposit secures your place in the training and allows Kula to make commitments including venue hire, teaching staff, administration, course preparation and course materials.

The deposit may be transferred to another eligible participant subject to the conditions in Section 4.

A deposit cannot be exchanged for cash or transferred to a different course unless Kula agrees otherwise in writing.

4. TRANSFER OF YOUR PLACE

If you are unable to attend, you may request to transfer your place to another person.

Any transfer must be approved by Kula before the replacement participant attends the training.

The replacement participant must:

  • meet any course prerequisites;

  • agree to these Terms & Conditions;

  • complete any required enrolment information; and

  • pay any difference in course fees where applicable.

Kula is not responsible for finding a replacement participant.

Any private financial arrangement between the original participant and replacement participant is entirely between those parties.

A course place may not be sold for more than the original purchase price.

Once a transfer has been approved, the original participant no longer has a right to attend the training.

5. CANCELLATION BY THE PARTICIPANT

If you cancel your enrolment:

  • your deposit remains non-refundable; and

  • any additional payments will be dealt with according to the cancellation terms communicated for the specific training.

Where Kula has incurred non-refundable costs relating to your enrolment, including venue hire, teacher costs, administration, course materials or other expenses, these may be taken into account when determining any refund, subject to applicable law.

6. PAYMENT PLAN & WITHDRAWAL

If you choose a payment plan, the payment plan is a method of paying the agreed course fee and does not change the total amount payable.

If you withdraw part-way through a training, you may not automatically stop future instalments.

Any request to alter or terminate a payment arrangement must be made in writing and will be considered by Kula in accordance with the applicable cancellation terms and New Zealand law.

7. MINIMUM ENROLMENT NUMBERS

Kula reserves the right to cancel or postpone a training where minimum enrolment numbers are not reached.

If Kula cancels a training, participants will receive the remedy required under applicable law and the circumstances of the cancellation.

Where appropriate, Kula may offer:

  • transfer to another scheduled training or retreat;

  • an alternative training date; or

  • a refund of amounts paid for the affected training.

Kula will not be responsible for travel, accommodation or other expenses incurred by participants in relation to a training unless required by law.

8. COURSE DATES & SCHEDULE

Participants are responsible for checking the course dates and ensuring they are able to attend the required sessions before enrolling.

Kula will make reasonable efforts to deliver the training according to the published schedule.

However, Kula reserves the right to make reasonable changes to:

  • dates or session times;

  • teaching staff;

  • guest teachers;

  • venue;

  • course structure;

  • teaching methods; or

  • course content,

where circumstances reasonably require it.

Where reasonably possible, significant changes will be communicated in advance.

9. ATTENDANCE

Attendance is an essential part of teacher training.

Participants are expected to attend all required sessions and arrive on time.

If you are unable to attend a session, you should notify the Lead Teacher as soon as reasonably possible.

Kula may require participants who miss training to complete additional learning, practical work, assessments or replacement training before certification can be awarded.

Kula does not guarantee that missed sessions can be repeated or that a make-up session will be available.

Repeated lateness or absence may affect a participant's ability to successfully complete the programme.

10. COMPLETION & CERTIFICATION

Where a certificate is offered, certification is conditional upon the participant meeting the course requirements.

These may include:

  • required attendance;

  • participation in practical sessions;

  • completion of assignments;

  • teaching assessments;

  • written assessments;

  • practical assessments;

  • completion of required teaching hours; and/or

  • other requirements communicated during the training.

Payment of the course fee alone does not guarantee certification.

Kula reserves the right to withhold certification where the required standards have not been met.

Where appropriate, Kula may provide reasonable guidance about what is required to complete outstanding course requirements.

11. EXTERNAL ACCREDITATION & PROFESSIONAL REGISTRATION

Completion of a Kula teacher training does not automatically guarantee acceptance, registration or recognition by any external organisation.

Participants are responsible for independently checking the requirements of:

  • Yoga Alliance;

  • yoga or Pilates insurance providers;

  • professional associations;

  • employers;

  • studios;

  • local authorities; or

  • any other organisation with which they intend to register or work.

Where a particular training is advertised as meeting a specific accreditation or registration requirement, Kula will provide information about that accreditation as accurately as reasonably possible.

12. PHYSICAL PRACTICE

Teacher training may involve physical yoga practice, movement, demonstrations, anatomy practicals, teaching practice, assisting and other physical activities.

Participants are responsible for working within their own physical capabilities.

Participants should notify Kula or the relevant teacher of any physical limitation that may affect their safe participation.

Participants are always encouraged to modify practices or decline an activity where appropriate.

Nothing taught during a Kula training constitutes medical diagnosis, treatment or individual medical advice.

13. HANDS-ON ASSISTING & CONSENT

Where hands-on assisting is included, consent and personal boundaries must be respected at all times.

No participant is required to give or receive hands-on assistance without their consent.

Participants must immediately respect another person's request to stop physical contact.

Hands-on practices must only be performed within the scope taught during the training.

Kula may remove a participant from practical activities where their conduct compromises another person's safety, consent or personal boundaries.

14. COURSE MATERIALS & INTELLECTUAL PROPERTY

All Kula manuals, presentations, written materials, worksheets, sequences, teaching resources, recordings and other course content remain the intellectual property of Kula and/or the relevant content creator unless otherwise stated.

Course materials are provided for the participant's personal educational use.

Participants may use the knowledge, skills and concepts learned during the training in their own teaching practice.

However, Kula's proprietary materials may not be:

  • copied;

  • reproduced;

  • republished;

  • distributed;

  • uploaded online;

  • sold;

  • shared with people who have not enrolled;

  • used to create another teacher training; or

  • represented as the participant's own original course material.

Participants must not reproduce Kula's manuals or substantial portions of the curriculum for commercial use without written permission.

15. RECORDING & PHOTOGRAPHY

Participants may not audio-record, video-record, photograph or otherwise reproduce lectures, demonstrations, practical sessions or course content without prior permission from Kula.

This includes recording sessions for personal use.

Kula may photograph or record portions of the training for educational, promotional, social media or administrative purposes.

If you do not wish to appear in promotional photography or video, please notify Kula in writing.

Participants must not photograph or record other participants without their consent.

16. CONFIDENTIALITY & RESPECT FOR PEERS

Teacher training can involve personal sharing, reflective exercises and discussions of individual experiences.

Participants are expected to respect the privacy of fellow participants and not share another participant's personal information or personal disclosures outside the training without their permission.

17. PROFESSIONAL & RESPECTFUL CONDUCT

Kula is committed to providing a safe, respectful and inclusive learning environment.

Participants are expected to treat teachers, staff, guest teachers and fellow participants with respect.

Bullying, harassment, discrimination, intimidation, threatening behaviour, inappropriate sexual conduct or serious disruptive behaviour will not be tolerated.

Kula may require a participant to leave the training where their conduct seriously compromises the safety, wellbeing or learning environment of others.

Any refund or outstanding payment obligations in such circumstances will be dealt with in accordance with applicable law and the circumstances of the individual case.

18. PERSONAL BELONGINGS

Participants are responsible for their own belongings while attending training.

Kula is not responsible for loss, theft or damage to personal belongings except where liability cannot lawfully be excluded.

19. COURSE RESOURCES & INCLUDED BENEFITS

Where additional benefits are included with a training — such as class passes, workshops, manuals, recordings or other resources — these are subject to the specific terms and expiry dates communicated at enrolment.

Unless otherwise stated, included benefits:

  • have no cash value;

  • cannot be exchanged for cash; and

  • cannot be transferred independently of the course enrolment.

Where a class pass or other benefit has an expiry date, it must be used within that period unless Kula agrees otherwise.

20. ILLNESS, INJURY & PERSONAL CIRCUMSTANCES

If a participant becomes ill or injured during a training, Kula may recommend that they modify or cease participation where reasonably necessary for their safety.

If illness, injury, pregnancy, family circumstances or another personal situation prevents attendance, the standard cancellation and transfer terms continue to apply.

Kula will consider reasonable requests on a case-by-case basis but cannot guarantee a refund, transfer or alternative attendance arrangement.

21. CANCELLATION OR POSTPONEMENT BY KULA

Kula may cancel or postpone a training due to circumstances including:

  • minimum enrolment numbers not being reached;

  • serious illness or unavailability of key teaching staff;

  • venue closure or availability issues;

  • natural disasters;

  • government restrictions;

  • significant operational issues; or

  • circumstances making delivery unsafe or impractical.

Where this occurs, Kula will act reasonably and in good faith and provide the remedy required under applicable law.

Where possible, Kula may offer an alternative date, transfer or alternative delivery arrangement.

22. EVENTS OUTSIDE OUR REASONABLE CONTROL

Kula is not responsible for delays, changes or cancellation caused by circumstances outside our reasonable control, including natural disasters, extreme weather, government restrictions, venue closure, serious illness, public health events, transport disruption or other events that make delivery impractical or unsafe.

Where possible, Kula will work to provide an alternative solution.

23. NO GUARANTEE OF PROFESSIONAL OUTCOME

Kula provides education and training for professional and personal development.

While we aim to provide high-quality training and support, we do not guarantee that completing a training will result in:

  • employment;

  • clients;

  • income;

  • teaching opportunities;

  • business success;

  • external accreditation; or

  • any other particular professional outcome.

24. LIABILITY

Kula will provide the training with reasonable care and skill and in accordance with applicable New Zealand law.

Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies that cannot legally be excluded, restricted or modified.

To the extent permitted by law, Kula is not responsible for losses arising from circumstances outside our reasonable control or losses that are not reasonably foreseeable.

25. CHANGES TO THESE TERMS

Kula may update these Terms & Conditions from time to time.

The Terms & Conditions applicable to your enrolment are those provided to you at the time of booking, except where changes are required by law or are otherwise reasonably necessary and do not unfairly disadvantage you.

26. ACCEPTANCE

By paying your deposit or otherwise confirming your enrolment, you confirm that you:

  • have read and understood these Terms & Conditions;

  • understand that your deposit is non-refundable;

  • understand your payment obligations;

  • understand the attendance and certification requirements; and

  • agree to comply with these Terms & Conditions throughout the training.

27. GOVERNING LAW

These Terms & Conditions are governed by the laws of New Zealand.

Nothing in these Terms & Conditions affects any rights or remedies available to participants under applicable New Zealand consumer law.
