KULA STUDIO RETREAT TERMS & CONDITIONS

These Terms & Conditions apply to all retreats organised and operated by Kula Studio / Kula Yoga Ltd (“Kula”, “we”, “us” or “our”).

By making a booking or paying a deposit, you acknowledge that you have read, understood and agreed to these Terms & Conditions.

1. Booking & Payment

A booking is confirmed once the required deposit has been paid.

The deposit is non-refundable, however it may be transferred to another person in accordance with these Terms & Conditions.

The remaining balance must be paid by the date specified at the time of booking.

Your booking is for the specific retreat, dates, accommodation and inclusions stated in your booking confirmation. The booking confirmation and retreat information provided at the time of purchase form part of these Terms & Conditions.

By confirming your booking, you agree to pay the full retreat price, regardless of whether you subsequently choose to participate in all activities included in the retreat.

2. Deposits

All retreat deposits are non-refundable.

The deposit may be transferred to another eligible participant in accordance with Section 3.

The deposit cannot be transferred to another retreat, converted into a credit or refunded unless Kula agrees otherwise in writing or this is required by applicable law.

3. Transfer of Booking

If you are unable to attend, you may request to transfer your booking to another person.

Transfers are subject to:

  • written notification to Kula;

  • approval by Kula;

  • the replacement participant meeting any relevant booking requirements;

  • the replacement participant agreeing to these Terms & Conditions;

  • payment of any difference in price applicable to the booking; and

  • the transfer being completed before the deadline specified by Kula.

Kula is not responsible for finding a replacement participant.

Any private financial arrangement between the original participant and replacement participant is their responsibility and does not involve Kula.

A booking may not be transferred for more than the original purchase price.

Once a transfer has been approved, the original participant no longer has a right to attend the retreat or seek a refund from Kula.

4. Participant Cancellation

If you cancel your booking, your deposit remains non-refundable.

Any additional payments will be subject to the cancellation terms communicated for the specific retreat.

Where cancellation occurs after Kula has incurred non-refundable costs on your behalf, including accommodation, venue, catering, transport, activities or other supplier costs, any refund will take those costs into account.

Where reasonably possible, Kula will make reasonable efforts to minimise cancellation losses and facilitate a transfer of the booking to another participant.

We strongly recommend purchasing comprehensive travel insurance at the time of booking that covers cancellation, illness, injury and travel disruption.

5. Payment Plans

Where a payment plan is offered, the participant remains responsible for the full retreat price.

Payment instalments must be paid by the dates specified at the time of booking.

Failure to make an instalment payment may result in Kula suspending the booking or cancelling the participant's place.

If a booking is cancelled because required payments have not been made, any amounts already paid may be retained to the extent permitted by applicable law and these Terms & Conditions.

6. Minimum Numbers

Some retreats require a minimum number of participants to operate.

Kula reserves the right to cancel or postpone a retreat if minimum enrolment numbers are not reached.

If Kula cancels a retreat for this reason, participants will receive the remedy required under applicable law and the circumstances of the cancellation. Where appropriate, Kula may offer a transfer to another retreat or a refund of amounts paid for the affected retreat.

Kula will not be responsible for additional costs incurred by participants, including flights, independently booked accommodation, visas, travel insurance or other travel expenses, unless required by law.

7. Cancellation or Changes by Kula

Kula may need to cancel, postpone or materially alter a retreat due to circumstances including minimum numbers, venue availability, supplier issues, serious illness or unavailability of key personnel, or circumstances affecting the safety or viability of the retreat.

Where this occurs, Kula will act reasonably and in good faith and provide participants with the remedy required by applicable law and the circumstances of the situation.

Where reasonably possible, Kula may offer an alternative date, transfer or other reasonable solution.

8. Events Outside Our Reasonable Control

Kula is not responsible for circumstances outside our reasonable control, including:

  • natural disasters;

  • extreme weather;

  • fire or flood;

  • epidemics or pandemics;

  • government restrictions;

  • border closures;

  • political unrest or civil disturbance;

  • war or terrorism;

  • strikes;

  • transport disruption;

  • significant travel disruption;

  • venue closure; or

  • other events that make the retreat unsafe or impractical to operate.

Where such circumstances occur, Kula will make reasonable efforts to determine the best available option and minimise the impact on participants.

Any refunds, credits or transfers will take into account amounts Kula is able to recover from suppliers and the remedies available under applicable law.

9. Travel & Flights

Unless expressly stated otherwise, flights, airport transfers, visas, travel insurance and personal travel expenses are not included in the retreat price.

Participants are responsible for ensuring they have:

  • a valid passport;

  • any required visas or travel permissions;

  • appropriate travel insurance;

  • any required health or travel documentation;

  • suitable travel arrangements; and

  • sufficient time to arrive at the retreat location.

Kula is not responsible for missed flights, flight cancellations, delays, lost luggage, airline changes or other travel disruption outside Kula's reasonable control.

Participants should avoid making non-refundable travel arrangements until they have carefully reviewed the retreat cancellation terms.

10. Accommodation

Accommodation is provided as described in the individual retreat information.

Room allocations are subject to availability and the accommodation arrangement selected at booking.

Where shared accommodation is booked, Kula cannot guarantee a particular roommate unless expressly agreed in writing.

Participants are responsible for reasonable costs arising from damage they cause to accommodation or other property.

11. Food & Dietary Requirements

Participants must notify Kula of any allergies, intolerances or dietary requirements by the deadline specified for the retreat.

Kula will communicate dietary requirements to relevant accommodation and catering providers where reasonably possible.

However, Kula cannot guarantee that food preparation environments will be completely free from allergens or cross-contamination.

Participants with serious or life-threatening allergies remain responsible for taking appropriate precautions and carrying any necessary medication.

12. Retreat Programme & Changes

Kula reserves the right to make reasonable changes to the retreat programme, including changes to:

  • teachers or facilitators;

  • yoga, Pilates, movement or wellness activities;

  • accommodation;

  • venues;

  • excursions;

  • activity providers;

  • meal arrangements; and

  • timings or schedules.

Where reasonably possible, significant changes will be communicated in advance.

Reasonable changes to individual activities, teachers, venues or timings do not automatically entitle participants to a refund where the retreat continues to be substantially provided.

13. Physical Activities & Personal Responsibility

Retreat activities may include yoga, Pilates, meditation, breathwork, hiking, swimming, excursions and other physical or wellness activities.

Participants are responsible for determining whether an activity is appropriate for their own physical condition, experience and abilities.

Participants must advise Kula or the relevant teacher/facilitator of any injury, physical limitation or other relevant circumstance that may affect their ability to participate safely.

Participants may modify or decline an activity at any time.

Nothing provided during the retreat constitutes medical advice, diagnosis or treatment.

14. Medical Conditions & Emergency Care

Participants are responsible for informing Kula of any relevant medical or physical considerations that may affect their safe participation.

In an emergency, Kula may contact local emergency services or seek appropriate medical assistance on a participant's behalf.

Participants are responsible for their own medical expenses, treatment and associated costs except where otherwise required by law.

Participants should ensure their travel insurance provides appropriate medical and emergency cover.

15. Alcohol, Drugs & Behaviour

Participants are expected to behave respectfully towards other participants, teachers, facilitators, staff, accommodation providers and local communities.

Bullying, harassment, discrimination, threatening behaviour, abusive conduct or behaviour that compromises the safety or wellbeing of others will not be tolerated.

Illegal drugs are strictly prohibited.

Alcohol consumption must comply with local laws and the rules of the retreat venue.

Kula reserves the right to require a participant to leave the retreat where their behaviour is seriously disruptive, unsafe, threatening or materially impacts the experience or wellbeing of other participants.

Where a participant is required to leave for serious misconduct, no refund will ordinarily be provided, subject always to applicable law.

16. Personal Belongings

Participants are responsible for their own belongings, valuables, passports, electronic devices and luggage.

Kula is not responsible for loss, theft or damage to personal belongings except where liability cannot lawfully be excluded.

17. Photography & Video

Photography and video may be taken during the retreat for Kula's promotional, social media and educational purposes.

Kula will make reasonable efforts to respect participants who have requested not to appear in promotional content.

If you do not wish to appear in Kula promotional photography or video, please notify us in writing before the retreat.

Participants must not photograph or record other participants in a way that compromises their privacy without their consent.

18. Liability

Kula will provide the retreat services with reasonable care and skill and in accordance with applicable New Zealand law.

Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies that cannot legally be excluded, restricted or modified.

To the extent permitted by law, Kula is not responsible for loss arising from circumstances outside our reasonable control or for losses that are not reasonably foreseeable.

19. Travel Insurance

Comprehensive travel insurance is strongly recommended and should be purchased as soon as your booking is confirmed.

Your policy should ideally cover:

  • cancellation;

  • illness and injury;

  • medical expenses;

  • emergency repatriation;

  • lost or delayed luggage;

  • travel delays; and

  • travel disruption.

20. Booking Information & Inclusions

The retreat price, dates, accommodation, inclusions and exclusions will be communicated at the time of booking.

If there is any difference between general promotional material and the specific booking confirmation, the booking confirmation will take precedence to the extent permitted by law.

21. Acceptance of Terms

Payment of the retreat deposit constitutes acceptance of these Terms & Conditions.

By booking, you confirm that you have had an opportunity to read these Terms & Conditions and understand the cancellation, transfer and payment obligations associated with your booking.

22. Governing Law

These Terms & Conditions are governed by the laws of New Zealand.

Nothing in these Terms & Conditions affects any rights a participant has under applicable New Zealand consumer law.
